Terms and Conditions

Last updated: 29 September 2026

These Terms and Conditions ("Terms") govern your use of tripgraber.com (the "Website") and any services you engage from Trip Graber Pvt. Ltd. ("Trip Graber", "we", "us" or "our"), a company registered in India with its office at A70 – 2nd Floor, Sector 2, Noida 201301, Uttar Pradesh.

By using the Website or engaging our services, you agree to these Terms. If you do not agree to them, please do not use the Website or submit an enquiry. You confirm that you are at least 18 years old and able to enter into a binding contract.

What We Do – and What We Do Not Do

Trip Graber is a travel technology consulting and marketing agency. We also provide paid travel advisory services to individual travellers.

Please read this carefully: we are not an airline, hotel, tour operator, transport provider or online booking platform. We do not own, operate or control any travel service. Where we arrange a booking, we do so as your agent with a third-party supplier, and that supplier's own terms, conditions, fare rules, cancellation policies and liability limits apply to the service you receive from them. Your contract for the travel service itself is with that supplier, not with us.

Any prices, availability, itineraries, images or durations shown on the Website are illustrative examples of work we have done. They are not offers, are not guaranteed, and are subject to change and to confirmation with the relevant supplier at the time of booking.

Services for Travel Businesses

Scope and proposals

Consulting, integration, website and marketing work is carried out on the basis of a written proposal or statement of work that sets out the deliverables, timelines, assumptions and fees. No work begins until you have approved that document in writing. Anything not listed in it is out of scope and, if you want it, will be quoted separately.

Fees and payment

Fees, the payment schedule and any retainer are stated in the approved proposal. Unless the proposal says otherwise, invoices are payable within 15 days of the invoice date. Fees are exclusive of GST and any other applicable taxes, which will be charged additionally. Third-party costs – advertising spend, hosting, licences, API fees, domain charges and similar – are your responsibility and are not included in our fees unless expressly stated.

We may suspend work on overdue accounts after giving written notice. Timelines are extended by any period during which work is suspended for non-payment or while we are waiting on you.

Your responsibilities

To deliver on time we depend on you. You agree to provide, within a reasonable period, the access, credentials, content, approvals and information we reasonably request; to nominate a single point of contact authorised to approve work; and to ensure that any material you supply to us does not infringe anybody else's rights. You are responsible for the accuracy and legality of the content, offers and prices you ask us to publish or advertise.

Intellectual property

On full payment of all amounts due for an engagement, ownership of the final deliverables created specifically for you under that engagement passes to you. We retain ownership of our pre-existing tools, frameworks, templates, code libraries and know-how, along with anything we develop that is general in nature, and we grant you a perpetual, non-exclusive licence to use those elements to the extent they are embedded in your deliverables. Third-party components, plugins, stock assets and licensed software remain subject to their own licences.

Confidentiality

Each party will keep the other's non-public business information confidential and use it only for the purpose of the engagement. This obligation survives the end of the engagement. It does not apply to information that is or becomes public through no fault of the receiving party, or that must be disclosed by law.

No guarantee of results

Search rankings, advertising costs, conversion rates, traffic and booking volumes depend on factors outside our control, including search engine and platform algorithms, competitor activity, your pricing and your market. We will apply professional skill and care, and report honestly on what the numbers show, but we do not guarantee any particular ranking, cost per booking, revenue figure or return on investment, and no such guarantee should be inferred from any projection, estimate or case study we share.

Termination

Either party may terminate an engagement by giving 30 days' written notice, or immediately if the other party commits a material breach and fails to remedy it within 15 days of written notice. On termination you remain liable for all work performed and all third-party costs committed up to the termination date. Retainers and amounts paid for work already delivered are not refundable. See our Cancellation Policy for the notice and handover process.

Services for Travellers

These are paid advisory services

Tour package guidance and customised travel planning are professional advisory services and are charged for. The fee is for our planners' time and expertise. It is separate from, and additional to, the cost of any flights, hotels, transport or activities you subsequently book, whether you book them through us or yourself.

How the fee works

Before any work begins, we will tell you in writing what the planning fee is for your specific requirement, based on the destination, trip length, number of travellers and complexity. The fee is payable in advance. We will not start work, and no fee becomes payable, until you have confirmed the quoted amount in writing.

What you receive

Tour package guidance includes a written comparison of the packages you have shortlisted, a review of inclusions, exclusions and likely hidden costs, and our recommendations on season, route, hotel category and what to negotiate.

Customised travel planning includes a day-by-day itinerary with timings and travel legs, recommendations for stays and experiences, an indicative budget breakdown per traveller, and two rounds of revisions. Further revisions, or a change of destination or dates after the plan is delivered, may be charged as additional work at our then-current rates.

Budgets and estimates

Any budget figure in a plan is an estimate prepared in good faith on the basis of prices and exchange rates available at the time of preparation. Airfares, hotel rates, taxes and exchange rates change constantly. Actual costs at the time of booking may be higher or lower, and we are not liable for the difference.

Bookings

You are free to book the plan yourself or ask us to arrange bookings for you. Where we book on your behalf, we act as your agent with the supplier, supplier terms apply, and payment for the travel service goes to that supplier or through us to that supplier. Supplier cancellation and amendment charges are your responsibility.

Cancelling a planning engagement

If you cancel before our planners have begun work, the planning fee is refunded in full. Once work has begun, the fee is non-refundable, because it pays for time already spent. If we are unable to deliver the plan for reasons attributable to us, we will refund the fee in full. Our Cancellation Policy and Refund Policy set this out in detail.

Your responsibilities as a traveller

You are responsible for holding a valid passport with sufficient remaining validity, for obtaining the correct visas and permits, for meeting health, vaccination and entry requirements, and for arranging adequate travel insurance. We will flag requirements we are aware of as part of our advice, but the obligation to comply with them, and the consequences of not doing so, rest with you. Visa decisions are made by the relevant authorities and are entirely outside our control; a refused visa is not grounds for a refund of our planning fee.

You must give us accurate information. We are not responsible for a plan or booking that turns out to be unsuitable because the dates, names, ages, budget or requirements you gave us were wrong or incomplete.

Use of the Website

You may not use the Website to submit false or misleading information, to send automated or bulk enquiries, to attempt to gain unauthorised access to our systems, to copy or scrape our content for commercial use, or for any unlawful purpose. All text, images, graphics, layout and code on the Website are owned by us or our licensors and may not be reproduced without our written permission.

We may suspend or withdraw access to the Website, in whole or in part, without notice. We do not guarantee that the Website will be uninterrupted or free of errors.

Third-Party Websites

The Website may link to sites we do not control. We are not responsible for their content, availability, terms or privacy practices, and a link does not imply endorsement.

Disclaimer

The Website and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we make no representation that the information on the Website is complete, current or error-free.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • We are not liable for the acts, omissions, delays, cancellations, overbooking, insolvency, service standards or safety practices of any airline, hotel, transport operator, tour operator, DMC, insurer or other third-party supplier.

  • We are not liable for events outside our reasonable control, including weather, natural disasters, epidemics, strikes, civil unrest, war, terrorism, government action, border closures, or failures of telecommunications or third-party platforms.

  • We are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or anticipated savings.

  • Our total aggregate liability arising out of or in connection with any engagement is limited to the amount you actually paid us in fees for that engagement.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud.

Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these Terms, from the inaccuracy of information you provided to us, or from content you asked us to publish or advertise on your behalf.

Governing Law and Disputes

These Terms are governed by the laws of India. If a dispute arises, you agree to first attempt to resolve it informally by contacting us. Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the courts at Gautam Buddha Nagar, Uttar Pradesh, India.

General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a right does not waive that right. You may not transfer your rights under these Terms without our written consent. These Terms, together with the applicable proposal or written quotation and our Privacy Policy, form the entire agreement between us. Where a signed proposal or statement of work conflicts with these Terms, that document prevails for that engagement.

Changes to These Terms

We may modify these Terms at any time. The revised version takes effect when posted on this page with an updated "Last updated" date. Where a change is material, we will make reasonable efforts to give at least 30 days' notice. Continued use of the Website or our services after that date means you accept the revised Terms. Engagements already underway continue under the Terms in force when they were agreed.
